Notes: In January 2025 Stockton-on-Tees Brorough Council received a Section 73 application to very conditions 4 and 6 of the planning application to remove the reference to gasificaiton from the description of the development to allow for a change of technology from the approved gasification plant to more conventional combustion, but this application was withdrawn in May 2026 - it is possible that this proposal could return in a different form as the reasons for withdrawal have not been stated (25/0148/VARY). A Shadow Habitats Regulations Assessment was submitted December 2025, and Natural England subsequently requested further information on 18 December 2025. Neither a Regulation 25 request or response are available on the Council website relating to this request for further informat as of 20 April 2026. Further information was subsequently provided. Planning permission for a gasification plant was issued to O2N Energy in February 2014 (13/2892/EIS). This was varied in January 2016 by O2N Energy to increase the capacity for the ERF including MRF from 150ktpa to 200ktpa (16/0195/VARY) and permission was technically implemented "through the demolition of buildings and works to construct the site access onto New Road". The permission was was varied again (20/2620/VARY) in January 2021, this time by EQtec, to "accommodate the proposed changes to the footprint and layout of the development", but retained the 200ktpa capacity and combination of gasification and MRF.
